बंगले पर अवैध निर्माण को तोड़ने का दिया आदेश
मुंबई: भाजपा नेता और राज्यसभा सांसद, केंद्रीय मंत्री नारायण राणे को बॉम्बे हाईकोर्ट से बड़ा झटका लगा है। दरअसल, बॉम्बे हाईकोर्ट ने बीएमसी BMC को दो सप्ताह के भीतर मुंबई में उनके बंगले में चल रहे अनधिकृत निर्माण को ध्वस्त करने का निर्देश दिया है। इसके अलावा 10 लाख रुपये का जुर्माना भी लगाया है। इस मामले की सुनवाई न्यायमूर्ति आरडी धानुका और न्यायमूर्ति कमल खता की खंडपीठ कर रही थी। बता दें कि बीएमसी की टीम ने कुछ महीने पहले समुद्र तटीय नियामक क्षेत्र (सीआरजेड) के मानक के उलंघन के लिए राणे के 'अधीश' बंगले का निरीक्षण किया था। उसके बाद राणे को बीएमसी अधिनियम 1888 की धार 351 (1) के तहत नोटिस जारी किया था। बीएमसी के-पश्चिम वार्ड के अधिकारी द्वारा जारी नोटिस में कहा गया था कि बंगले में किए गए परिवर्तन अनुमोदित योजनाओं के अनुरूप नहीं थे।
🔹 राणे के वकील ने मांगी छह महीने की मोहलत, मांग खारिज
राणे के वकील शार्दुल सिंह ने अदालत से छह सप्ताह के लिए अपने आदेश पर रोक लगाने की मांग की ताकि वह अपील में उच्चतम न्यायालय का दरवाजा खटखटा सकें। हालांकि बेंच ने इसे खारिज कर दिया। अदालत ने राणे के परिवार के स्वामित्व वाली कंपनी कालका रियल एस्टेट्स द्वारा दायर याचिका को खारिज कर दिया, जिसमें बीएमसी को निर्देश देने की मांग की गई थी कि वे पहले नागरिक निकाय द्वारा पारित आदेशों से अप्रभावित उनके दूसरे आवेदन पर फैसला करें।
🔹राणे ने के नोटिस को रद्द करने के लिए बॉम्बे हाईकोर्ट का किया था रुख
राणे ने बॉम्बे हाईकोर्ट में एक याचिका दायर कर केंद्रीय मंत्री नारायण राणे ने बृहन्मुंबई नगर निगम (बीएमसी) के नोटिस को रद्द करने की मांग की थी। राणे ने याचिका में बीएमसी की तरफ से 25 फरवरी, चार मार्च और 16 मार्च को दिए गए नोटिस को विकृत, अवैध और मूल अधिकारों का उल्लंघन बताया था। राणे के वकील अमोघ सिंह ने जस्टिस ए सैयद की पीठ के समक्ष याचिका पर शीघ्र सुनवाई की अपील की थी। इसके बाद बॉम्बे हाईकोर्ट ने अवैध निर्माण को तोड़ने पर कुछ दिन के लिए रोक लगा दी थी। हालांकि अब उन्हें बॉम्बे हाईकोर्ट से बड़ा झटका लगा है।
🔹जानें क्या था अनधिकृत निर्माण?
नोटिस में बंगले के भूतल और आठ मंजिलों में से सात में अनधिकृत तौर पर बदलाव किए जाने का उल्लेख किया गया है। बीएमसी के एक अधिकारी का कहना है कि पहली मंजिल से लेकर 8वीं मंजिल (7वीं मंजिल छोड़कर) तक बगीचे की जगह रूम बनवाए गए हैं जबकि नियम के मुताबिक आठ मंजिला बंगले के सभी फ्लोर पर बगीचे का क्षेत्र होना आवश्यक है।

In fact, the Bombay High Court has directed the BMC to demolish the ongoing unauthorized construction of his bungalow in Mumbai within two weeks. Apart from this, a fine of Rs 10 lakh has also been imposed. The matter was being heard by a division bench of Justice RD Dhanuka and Justice Kamal Khata. The BMC team had inspected Rane's 'Adheesh' bungalow a few months back for violating the norms of the Coastal Regulatory Zone (CRZ). After that a notice was issued to Rane under section 351(1) of the BMC Act 1888. The notice issued by the BMC K-West ward official stated that the changes made in the bungalow were not in accordance with the approved plans.
Rane's lawyer sought extension of six months, demand rejected
Rane's lawyer Shardul Singh sought a stay of his order for six weeks from the court so that he can approach the Supreme Court in appeal. However, the bench rejected it. The court dismissed the petition filed by Kalka Real Estates, a company owned by Rane's family, seeking a direction to the BMC to decide on his second application, unaffected by the orders passed by the civic body earlier.
Rane moves Bombay High Court to quash BMC notice
Rane had filed a petition in the Bombay High Court seeking quashing of the Brihanmumbai Municipal Corporation (BMC) notice by Union Minister Narayan Rane. Rane, in the petition, had termed the notices given by the BMC on February 25, March 4 and March 16 as perverted, illegal and a violation of fundamental rights. Rane's counsel Amogha Singh had appealed for an early hearing on the petition before a bench of Justice A Syed. After this, the Bombay High Court had banned the demolition of the illegal construction for a few days. However, now he has got a big setback from the Bombay High Court.
